Welcome to GrowthAdvisor.in ("Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, services, and tools (collectively, the "Services"). By accessing or using our Services, you ("Client," "you," or "your") agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Services & Scope

1.1 Service Offerings

We provide organic growth consulting services, including but not limited to:

  • SEO Strategy & Implementation (on-page, off-page, technical)
  • Content Marketing & Strategy (blogging, pillar content, conversion-focused copy)
  • Link-Building & Digital PR (white-hat backlink acquisition)
  • Technical SEO Audits & Fixes (site speed, crawlability, indexation)
  • Analytics & Performance Reporting (Google Analytics, Search Console, custom dashboards)

1.2 Custom Agreements

  • Services are tailored per a Statement of Work (SOW) or Proposal outlining deliverables, timelines, and pricing.
  • Any modifications require written approval from both parties.

2. Client Responsibilities

To ensure successful service delivery, you agree to:

  • Provide accurate business information (e.g., website access, analytics, competitor insights).
  • Assign a primary point of contact for communication and approvals.
  • Make timely payments as per the agreed schedule.
  • Notify us of any third-party restrictions (e.g., hosting limitations, compliance policies).

Failure to comply may delay deliverables, for which we are not liable.

3. Payments, Fees & Refunds

3.1 Pricing Structure

  • Fees are outlined in your proposal/contract (retainer, project-based, or hybrid).
  • Additional work outside the SOW will be billed at hourly or pre-negotiated rates.

3.2 Payment Terms

  • Invoices are due net 15 days unless otherwise specified.
  • Late payments incur 1.5% monthly interest (or the maximum allowed by law).
  • Chargebacks will result in immediate service suspension and may incur legal fees.

3.3 Refund Policy

  • Retainers: Non-refundable, as resources are allocated in advance.
  • Project-Based Work: Partial refunds are considered if services are undelivered due to our fault.
  • No refunds for lack of results (SEO is subject to external factors like algorithm changes).

4. Intellectual Property (IP) Rights

4.1 Our IP

  • Deliverables (reports, strategies, frameworks) are licensed for your internal business use only.
  • You may not resell, redistribute, or reverse-engineer our methodologies.

4.2 Your IP

  • You retain ownership of your website, content, and data.
  • By providing access, you grant us a limited license to analyse, modify, and optimise your assets for service delivery.

4.3 Portfolio Usage

We may showcase anonymised results/case studies unless a confidentiality agreement is in place.

5. Confidentiality & Data Protection

5.1 Non-Disclosure

Both parties agree to:

  • Keep business strategies, analytics, and proprietary methodsconfidential.
  • Not share sensitive information with competitors.

5.2 Data Security

  • We follow industry-standard encryption (SSL, secure file-sharing).
  • Client data is never sold to third parties.

5.3 GDPR/CCPA Compliance

  • If you are subject to data privacy laws, notify us in advance.
  • We adhere to data minimization (collecting only what’s necessary).

6. Limitations of Liability

6.1 No Guaranteed Outcomes

  • SEO is influenced by third-party algorithms (Google, Bing).
  • We do not guarantee specific rankings, traffic, or revenue increases.

6.2 Liability Cap

Our maximum liability is limited to fees paid in the last 6 months.

6.3 Indemnification

You agree to indemnify us against claims arising from:

  • Your misuse of our strategies.
  • Unauthorised website changes made by your team.

7. Termination & Suspension

7.1 Termination by Client

  • You may terminate with 30 days’ written notice.
  • Fees for work completed up to termination are non-refundable.

7.2 Termination by Us

We may suspend or terminate services if:

  • Payments are overdue by 30+ days.
  • You violate these Terms or engage in unethical SEO practices.

7.3 Post-Termination

  • You retain access to deliverables provided before termination.
  • We may delete stored data 90 days after termination.

8. Dispute Resolution

  1. Informal Negotiation (30-day good-faith discussion).
  2. Mediation (via a neutral third party, split cost).
  3. Binding Arbitration in [Jurisdiction, e.g., "Delhi, India"].

No class-action lawsuits permitted.

9. General Provisions

9.1 Governing Law

These Terms are governed by the laws of the judiciary of India

9.2 Force Majeure

Not liable for delays caused by events beyond our control (e.g., pandemics, hosting outages).

9.3 Updates to Terms

  • We may revise these Terms with 30 days’ notice.
  • Continued use = acceptance of changes.
